Terms of Service

These terms are an agreement between you and African Winter Wonderland Corp. (“AWWLAND”, “we”, “us”), a 501(c)(3) nonprofit registered in New Jersey. They cover awwland.org, the AWWLAND mobile app, and participation in AWWLAND trips and activities. By creating an account or booking a trip you accept them.

Participation in winter sports carries real risk of serious injury or death. Before joining any trip you must also read and sign the Liability Waiver and Assumption of Risk. Nothing in these terms limits what that document says.

1. Accounts

You must be 18 or older to create an account. Give accurate information and keep it current – we rely on your emergency contact details and on knowing your experience level to place you safely. You are responsible for what happens under your account and for keeping your password private.

Under-18s may participate only when accompanied by a parent or legal guardian, who books on their behalf and accepts these terms and the waiver for them.

2. Booking a trip

A booking is confirmed when your deposit is received. Places are limited and allocated in the order deposits arrive.

Deposit

The deposit is $140, made up of:

  • $100 – housing. Paid on to the property once your place is booked.
  • $40 – service fee. Covers the cost of arranging your place.

The deposit forms part of the total trip price; it is not charged on top.

Payment schedule

Each trip page shows its own schedule: the deposit, followed by second, third and final payments due on stated dates before departure. Missing a payment may cost you your place, and amounts already paid remain subject to the cancellation terms below.

Prices are estimates

Trip prices shown with an asterisk are anticipated costs. They are our best estimate at the time of publication and depend on lodging, transport, exchange rates and group size. If the final cost is higher, you will be billed the difference and told in writing before the charge, with a reasonable opportunity to withdraw under the cancellation terms. If the final cost is lower, the difference is refunded or credited.

3. What is not included

Unless a trip page says otherwise, the price excludes flights, lift tickets and passes, equipment rental, lessons, travel insurance, meals not listed, and personal expenses. Lift tickets are never included.

4. Cancellation and refunds

The $140 deposit is treated separately from the table above:

  • The $40 service fee is never refundable.
  • The $100 housing portion is not refundable once your place is booked, because it has already been paid to the property. The way to recover it is to find a replacement participant who takes your place and pays to current. Finding that replacement is your responsibility, though we will help where we reasonably can.

Cancellations must be sent in writing to support@awwland.org. The date we receive your email is the cancellation date.

If we cancel

We may cancel a trip for reasons including too few participants, weather, resort closure, or circumstances beyond our control. If we do, you receive a full refund of everything you have paid, less the $40 service fee. You may instead choose to apply the balance to another AWWLAND trip in the same season.

We are not responsible for costs you incurred separately – flights, lift tickets, insurance, time off work. This is why we recommend travel insurance.

Before you dispute a charge

If something looks wrong with a payment, contact us at support@awwland.org before raising a dispute or chargeback with your bank or card issuer. Nearly everything is resolved faster directly, and a chargeback raised without contacting us first may result in your place being cancelled under these terms.

5. Travel documents, insurance and fitness

You are responsible for your own passport, visas and entry requirements, and for any vaccinations or health precautions your destination requires. We strongly recommend travel insurance covering medical treatment, evacuation and trip cancellation, particularly for international trips. It is recommended, not required.

You are responsible for judging your own fitness. Do not take part in an activity you are not physically fit for.

6. Coaching and instruction

Coaching offered on AWWLAND trips is provided by experienced volunteer members, not licensed or certified instructors. It is peer guidance offered in good faith, not professional instruction. You take part in coaching sessions at your own risk. If you want certified instruction, book a lesson through the resort’s own ski or snowboard school.

7. Transport

Transport arrangements vary by trip. Some trips involve group transport we arrange with a third-party carrier; on others, participants travel independently. Each trip page describes the arrangement. Where transport is provided by a third party, that carrier is responsible for its own service, vehicles and drivers. Where you travel independently, you are responsible for your own journey, vehicle and insurance.

8. Conduct

AWWLAND exists to make winter sports welcoming. In return we ask that you:

  • treat other participants, staff, volunteers, resort employees and local communities with respect;
  • ski, ride and take part within your ability and follow all resort rules, signage and closures;
  • do not behave in a way that endangers yourself, the group or anyone else;
  • do not behave in a way that brings AWWLAND into disrepute.

We may suspend or remove you from an account, a trip or a future trip for behaviour detrimental to the reputation of the group, unsafe behaviour during activities, or behaviour that puts the group or others in danger. Removal from a trip in progress means you make your own way home at your own cost, and no refund is due. We will act proportionately, and other than in urgent safety situations we will explain our reasons.

9. Photography and media

AWWLAND trips are photographed. By taking part you grant us permission to use images and video of you, as set out in the Liability Waiver and Media Release. You may withdraw this at any time by emailing support@awwland.org; we will stop using your likeness going forward, though we cannot recall material already printed or shared.

Photographs on this website of resorts and destinations are used courtesy of the respective resorts and photographers and remain their property.

10. Content you submit

If we later add features that let you post reviews, photographs, comments or other material, the following applies. You keep ownership of what you post. You grant AWWLAND a non-exclusive, worldwide, royalty-free licence to host, store, reproduce, adapt and display it in connection with operating and promoting AWWLAND, for as long as you leave it posted plus a reasonable period afterwards.

You confirm you have the right to post it and that it does not infringe anyone’s rights. Do not post anything unlawful, hateful, harassing, deceptive, or that reveals someone else’s personal information without consent. We may remove any content, at our discretion, with or without notice, and may suspend accounts that repeatedly break these rules. We do not routinely pre-screen content and are not responsible for what participants post.

11. Donations

Donations are handled by Stripe and are tax-deductible to the extent permitted by law. Where you receive goods or services in return, only the amount above their fair market value is deductible. Donations are generally non-refundable; if you have made an error, contact us. Our EIN is available on request.

12. Intellectual property

The AWWLAND name, logo, site design and written content belong to African Winter Wonderland Corp. Please do not copy or reuse them without written permission.

13. Availability

We provide the website and app on an “as is” basis and do not guarantee uninterrupted or error-free operation. We may change, suspend or discontinue features at any time.

14. Limitation of liability

To the fullest extent permitted by law, AWWLAND’s total liability arising out of these terms or your use of the website or app is limited to the amount you paid us for the trip in question. We are not liable for indirect, incidental or consequential losses.

Nothing here limits liability for death or personal injury caused by our negligence, for fraud, or for anything else that cannot lawfully be excluded. Liability arising from participation in activities is governed by the Liability Waiver.

15. Governing law

These terms are governed by the laws of the State of New Jersey, without regard to conflict-of-law rules. Any dispute will be brought in the state or federal courts located in Mercer County, New Jersey, and you and we both consent to that jurisdiction.

16. Changes

We may update these terms. The date at the top shows when. For significant changes we will email registered participants, and continuing to use the site or book trips means you accept the updated version. Changes will not retroactively alter the cancellation terms of a trip you have already booked.
