Liability Waiver, Assumption of Risk & Media Release

This agreement is between African Winter Wonderland Corp. (“AWWLAND”), a New Jersey nonprofit at 8308 Forge Cir, Pennington, NJ 08534, and the participant named at signing.

1. The activities this covers

This agreement applies to every part of an AWWLAND trip, including:

• skiing, snowboarding and all downhill snow sports, on and off marked trails;
• snowmobiling, dog sledding, snowshoeing, hiking, tubing and other winter activities;
• coaching, instruction, orientation and practice sessions run by AWWLAND;
• transport to, from and during a trip, whether arranged by AWWLAND or undertaken independently;
• lodging, meals, social events, city extensions and free time forming part of a trip;
• travel between any of the above.

2. The risks

Winter sports are dangerous. Injuries are common and deaths occur. The risks include, and are not limited to:

• collisions with other people, trees, rocks, lift towers, snowmaking equipment, vehicles and terrain features;
• falls, loss of control, and being struck by others;
• changing snow and weather, ice, bare patches, moguls, cliffs, crevasses, tree wells and avalanche;
• chairlift, gondola and tow malfunction, and falls from them;
• equipment failure, including bindings that do and do not release;
• altitude sickness, hypothermia, frostbite, sunburn, dehydration and exhaustion;
• road accidents;
• the negligence of other participants, resort staff, carriers and third parties;
• the negligence of AWWLAND, its volunteers, officers and directors;
• delayed or inadequate medical treatment, particularly in remote terrain or abroad.

I understand these risks cannot be eliminated regardless of care taken, and that some are not foreseeable. I knowingly and voluntarily assume all of them, known and unknown.

3. My fitness and ability

I confirm I am physically and mentally fit to take part. AWWLAND does not collect medical information and does not assess my fitness. Judging that is entirely my responsibility, and I have consulted a doctor if there was any doubt.

I will not take part in any activity I am not physically fit for. I will stay within my ability, obey all resort rules, signage and closures, and stop when tired, unwell or conditions exceed my competence. I understand I may be asked to leave an activity if my conduct is unsafe.

4. Coaching is peer guidance, not professional instruction

5. Transport

I understand transport varies by trip. Where AWWLAND arranges transport with a third-party carrier, that carrier – not AWWLAND – is responsible for its vehicles, drivers and service. Where I travel independently, I am solely responsible for my journey, vehicle, licence and insurance.

6. Release of liability

In consideration of being permitted to participate, I agree that:

1. I release, waive and discharge African Winter Wonderland Corp. and its officers, directors, volunteers, coaches, trip leaders, employees and agents (together, the “Released Parties”) from all liability for any injury, disability, death, or loss of or damage to property arising from my participation, including where caused in whole or in part by the ordinary negligence of the Released Parties.
2. I will not sue the Released Parties for any such claim.
3. I indemnify and hold harmless the Released Parties against any claim brought by me or on my behalf, including reasonable legal costs.
4. I assume full responsibility for my own medical, evacuation and repatriation costs, and understand AWWLAND provides no insurance for me.

This release does not cover gross negligence, recklessness, or intentional or criminal misconduct by the Released Parties, and does not waive any right that cannot lawfully be waived.

This covers AWWLAND only

This agreement releases AWWLAND and the people listed above. It does not release resorts, lift operators, carriers, hotels, instructors or any other third party, each of whom may require its own waiver – typically when you buy a lift ticket. Signing this does not sign those, and it does not affect my rights against them.

7. Emergency medical treatment

If I am injured or ill and cannot give consent, I authorise AWWLAND to arrange emergency medical treatment, transport and evacuation on my behalf, and to share my emergency contact details with medical and rescue personnel.

I understand AWWLAND is not medically trained and is not obliged to provide or procure treatment, and that I am financially responsible for all costs of treatment, transport, evacuation and repatriation. I release the Released Parties from liability for any decision made in good faith in an emergency.

8. Media release

I grant AWWLAND permission to photograph and film me during trips and activities, and an irrevocable, worldwide, royalty-free licence to use those images, video and my likeness, name and voice in AWWLAND’s website, social media, newsletters, presentations, grant applications and promotional material.

I understand I receive no payment and have no right to inspect or approve the material. I may withdraw this permission at any time by emailing support@awwland.org, after which AWWLAND will stop using my likeness in new material, though it cannot recall material already printed, distributed or shared.

9. Conduct

I will treat other participants, volunteers, resort staff and local communities with respect, and I understand I may be removed from a trip – at my own cost, with no refund – for behaviour that endangers myself, the group or others, or that brings AWWLAND into disrepute.

11. Governing law

This agreement is governed by the laws of the State of New Jersey, without regard to conflict-of-law rules, and any dispute will be brought in the state or federal courts of Mercer County, New Jersey. It applies to trips wherever they take place, including in Canada and Italy.

If any part of this agreement is held unenforceable, the rest remains in force, and the unenforceable part will be limited to the minimum extent necessary rather than struck out entirely.
